Jay Britto Photography is a brand operated by Jay Britto LLC, a company registered in the State of Florida, United States. These Terms of Service ("Terms") govern your use of my website, accounts, products, and services. By accessing or using my services, you agree to be bound by these Terms and my Privacy Policy.

2. Eligibility

You must be at least 18 years of age to use my services or make purchases through my website. By using my services, you represent and warrant that you meet this requirement.

3. Accounts & Security

  • Users may create an account through my website (powered by Squarespace).

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

  • You agree to notify me immediately of any unauthorized use of your account.

  • I am not responsible for any loss or damage arising from your failure to protect your account information.

4. Orders and Payment

  • All orders are subject to acceptance and availability.

  • Prices are listed in USD and may change without notice.

  • Payments are securely processed via Squarespace’s payment providers (e.g., Stripe, PayPal). Jay Britto Photography does not store credit card details directly.

  • I reserve the right to cancel or refuse any order at my discretion.

5. Shipping and Fulfillment

  • Limited Edition prints are produced, signed, and shipped directly by Jay Britto Photography.

  • Open Edition prints and custom-framed products are fulfilled by my partner, Level Frames, and subject to their processing and shipping policies.

  • Design Trade Program members may access exclusive discounts; fulfillment remains subject to prints purchased through jaybrittophotography.com only. No discounts apply to Level Frames online purchases.

6. Returns and Guarantee

I offer a 100% satisfaction guarantee. If you are not completely satisfied with your purchase, please contact me within 14 days of receiving your item. I will work with you to resolve the issue, which may include replacement, credit, or refund, depending on the product type and fulfillment provider.

7. Design Trade Program

The Jay Britto Photography Design Trade Program (“Program”) provides exclusive benefits to qualified design professionals. By applying to and participating in the Program, you agree to the following terms, which apply in addition to our general Terms & Conditions:

Eligibility

  • The Program is open to U.S.-based interior designers, architects, and design professionals with an active business registration.

  • Applicants must provide a valid resale or tax exemption certificate during the application process.

  • Membership is subject to approval and may be granted, denied, or revoked at our sole discretion.

Tax Exemption

  • Tax-exempt purchasing is available only to approved members with current, verified resale or tax exemption documentation.

  • Documentation must remain up to date and compliant with the regulations of your state.

  • Tax exemption applies only to purchases intended for resale or qualifying business use.

Discounts

  • Trade discounts are applied via a member discount code at checkout and may not be combined with other promotions or offers.

  • Discounts do not apply to services or framing through third-party partners.

Program Use

  • Membership and benefits are non-transferable and may be used only by the approved business.

  • You agree to use the Program solely for professional purposes and not to misrepresent eligibility.

Program Changes

  • Jay Britto Photography reserves the right to modify, suspend, or terminate the Program or its terms at any time without prior notice.

8. Intellectual Property

All content, including but not limited to photographs, text, logos, and graphics, is the property of Jay Britto LLC or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or exploit any content without our express written permission.

9. User Conduct

You agree not to:

  • Use the site for any unlawful purpose

  • Impersonate another person or misrepresent your identity

  • Attempt to interfere with or disrupt our website or services

10. Limitation of Liability

To the fullest extent permitted by law, Jay Britto LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of my site or services.

11. Indemnification

You agree to indemnify and hold harmless Jay Britto LLC, its affiliates, officers, and employees from any claim, demand, or damage, including reasonable attorneys’ fees, arising out of your use of my services or your violation of these Terms.

12. Third-Party Services and Links

My site integrates third-party providers including Squarespace (accounts and checkout), Level Frames (framing and fulfillment), Riot Color (print production), Mailchimp (marketing emails), and Zapier (data transfer automation). Use of these services is subject to their own terms and policies.

13. Modifications to the Service

I reserve the right to modify or discontinue any part of the website or services without notice and without liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in the State of Florida, unless otherwise required by law.
